Although hemp is federally legal, it is still regulated state-to-state. It is the opposite of marijuana in this respect: marijuana is federally illegal, but legal under the statutes of certain states.
Make no mistake: hemp and hemp-derived products are legal in all 50 states, but there are statutes in certain states that restrict the methods of selling, purchasing, or consuming hemp. Some states have passed statutes that are overly restrictive on these methods, which—in an effort to be as legally compliant as possible—led us to prohibiting sales to consumers in such states.
What does the Farm Bill of 2013 mean for hemp?
The Farm Bill of 2013 was signed by President Obama on February 7, 2014, and its main purpose is to define industrial hemp and “to allow pilot programs and research to begin on industrial hemp and determine whether hemp farming would be beneficial for American farmers and businesses.”
Section 7606 (subtitled The Legitimacy of Industrial Hemp Research) this bill defines industrial hemp as “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”
